1Scope

This Privacy & Data Use Policy explains how ROW Seed collects, uses, discloses, sells, shares, licenses, retains, and protects information when users access or use ROW Seed’s website, application, dashboards, quote tools, order tools, payment tools, documents, communications, and related services collectively referred to as the “Platform.”

2Information We Collect

Account and contact information, including name, company name, title, email address, phone number, mailing address, billing address, shipping address, login credentials, user role, and account settings.

Business profile information, including contractor profile, supplier profile, service areas, product categories, certifications, licenses, insurance information, delivery capability, capacity, lead times, contact preferences, and operational details.

RFQ and project information, including quote requests, job names, project locations, delivery addresses, DOT references, bid details, engineer plans, specifications, seed mixes, product requirements, quantities, uploaded documents, site photos, delivery notes, and special instructions.

Quote, order, and transaction information, including supplier estimates, contractor-facing quotes, accepted orders, purchase orders, invoices, receipts, delivery receipts, supplier bills, payment status, fulfillment status, substitutions, cancellations, disputes, and communications.

Credit and payment information, including credit applications, trade references, credit limits, account status, payment method information, Stripe metadata, QuickBooks identifiers, tax exemption documents, EINs or tax identifiers where collected, invoices, receipts, and collection information.

Supplier information, including supplier capacity, inventory, product availability, delivery radius, certifications, weed-free status, pricing, payment instructions, uploaded invoices, compliance documents, and performance information.

Contractor information, including company profile, project demand, quote history, order history, payment behavior, credit status, tax exemption status, and communications.

CRM and prospect information, including imported prospect data, outreach source, assigned representative, validation tier, confidence level, lifecycle status, notes, and activity history.

Technical, device, and usage information, including IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, clicks, search activity, quote activity, account activity, timestamps, logs, cookies, analytics data, and Platform interaction data.

Derived, inferred, aggregated, and de-identified data, including pricing benchmarks, demand forecasts, supplier performance metrics, contractor demand metrics, market trends, regional purchasing trends, logistics insights, AR/AP metrics, markup and margin analytics, and data models.

3How We Use Information

ROW Seed may use information for any lawful business purpose, including to operate, maintain, provide, secure, personalize, improve, and commercialize the Platform.

ROW Seed may use information to create and manage accounts, review supplier approvals, review contractor credit, facilitate RFQs, generate quotes, issue purchase orders, issue invoices, process payments, route supplier payments, calculate taxes, manage fulfillment, provide support, resolve disputes, prevent fraud, enforce agreements, and comply with law.

ROW Seed may use information to develop analytics, dashboards, reports, benchmarks, pricing tools, sourcing tools, supplier tools, contractor tools, market intelligence, artificial intelligence, machine learning, automation, and decision-support systems.

ROW Seed may use information for marketing, advertising, sales, prospecting, customer relationship management, business development, research, product development, internal reporting, and corporate transactions.

4Data Commercialization, Sale, Sharing, and Licensing

To the fullest extent permitted by applicable law, ROW Seed may collect, use, disclose, transfer, sell, share, license, commercialize, publish, distribute, monetize, and otherwise exploit information collected through or derived from the Platform.

This may include aggregated, anonymized, de-identified, statistical, inferred, or derived data; market trends; demand data; pricing benchmarks; quote benchmarks; product availability insights; supplier performance metrics; contractor demand metrics; regional purchasing trends; logistics and fulfillment insights; data products; reports; dashboards; analytics; market intelligence; advertising audiences; lead-generation datasets; AI models; machine-learning models; automation tools; decision-support systems; and other commercial data products or services.

Where required by applicable law, ROW Seed will provide required notices, consent mechanisms, opt-out rights, contractual restrictions, or other privacy controls before selling or sharing personal information. ROW Seed may use aggregated, anonymized, de-identified, derived, or non-personal information without restriction except where prohibited by law.

5How We Disclose Information

ROW Seed may disclose information to Contractors and Suppliers as needed to facilitate RFQs, quotes, orders, delivery, fulfillment, communications, and disputes, while preserving confidentiality protections described in ROW Seed’s Terms & Conditions.

ROW Seed may disclose information to payment processors, banks, billing providers, collection providers, shipping and logistics providers, hosting providers, cloud providers, software providers, analytics providers, tax providers, accounting systems, communication providers, fraud-prevention providers, identity-verification providers, legal advisors, accountants, auditors, insurers, advertising partners, marketing partners, data partners, corporate transaction counterparties, government authorities, courts, regulators, law enforcement, and other parties as permitted by law.

ROW Seed may disclose information to enforce agreements, prevent circumvention, investigate fraud, protect rights, comply with legal obligations, and complete mergers, acquisitions, financing transactions, reorganizations, asset sales, or similar transactions.

6Cookies and Tracking Technologies

ROW Seed may use cookies, pixels, tags, SDKs, local storage, session identifiers, device identifiers, log files, email tracking technologies, analytics tools, advertising technologies, retargeting technologies, measurement tools, session replay tools where lawful, fraud-prevention tools, customer relationship management tools, and similar technologies to operate the Platform, remember preferences, analyze usage, improve services, detect fraud, personalize experiences, attribute traffic, measure communications, support marketing, support business development, and create analytics or data products. The specific technologies, categories, vendors, and business purposes may change over time without advance notice, subject to applicable law. See the ROW Seed Cookie Policy for details.

Users may be able to control cookies through browser settings, device settings, consent tools, cookie preference tools, opt-out links, industry opt-out mechanisms, or privacy preference signals where required by applicable law. Some Platform features may not function properly if cookies or similar technologies are disabled.

7Data Retention

ROW Seed may retain information for as long as necessary or appropriate for business, legal, operational, tax, accounting, analytics, security, dispute-resolution, anti-circumvention, compliance, and archival purposes.

A request to delete, close, or deactivate an account may disable access to the Platform, but ROW Seed may retain business records, accounting records, tax records, payment records, RFQs, quotes, purchase orders, invoices, receipts, delivery records, credit records, supplier records, contractor records, communications, audit logs, backups, aggregated data, de-identified data, derived data, and Platform Data where required or permitted by law or legitimate business purposes.

8Security

ROW Seed uses reasonable administrative, technical, and organizational measures designed to protect information. No system is completely secure, and ROW Seed cannot guarantee absolute security. Users are responsible for protecting account credentials and promptly notifying ROW Seed of unauthorized access or suspected security incidents.

9Privacy Rights

Depending on your location, you may have rights to access, correct, delete, or receive a copy of personal information; opt out of certain sales, sharing, targeted advertising, or profiling; restrict or object to certain processing; withdraw consent where processing is based on consent; appeal certain privacy decisions; and avoid unlawful discrimination for exercising privacy rights.

ROW Seed may verify requests and may deny or limit requests where permitted by law, including for legal compliance, security, fraud prevention, contractual performance, accounting, tax records, dispute resolution, internal analytics, and business recordkeeping.

10Do Not Sell or Share Rights

If applicable privacy law gives you the right to opt out of the sale or sharing of personal information, ROW Seed will provide a method to exercise that right. ROW Seed may provide a footer link titled “Do Not Sell or Share My Personal Information” or a similar legally required mechanism.

Opt-out requests may not affect ROW Seed’s ability to use aggregated, anonymized, de-identified, derived, or non-personal information, or to disclose information to service providers, contractors, processors, or other parties where permitted by law.

11Business Contacts and B2B Data

ROW Seed is primarily a business-to-business platform. ROW Seed may collect and process business contact information, company information, project information, supplier information, contractor information, credit information, quote information, and transaction information in a commercial context. Business contact information may still be personal information under certain laws.

12Children’s Privacy

The Platform is intended for business users and is not directed to children. ROW Seed does not knowingly collect personal information from children under 13 or under any higher age threshold required by applicable law.

13International Users

If you access the Platform from outside the United States, information may be transferred to, stored in, or processed in the United States or other countries where privacy laws may differ from those in your jurisdiction.

14Changes to This Policy

ROW Seed may update this Policy from time to time. Updates will be posted on the Platform with a revised “Last Updated” date. Continued use of the Platform after updates means you acknowledge the revised Policy.
